Understanding Minnesota's No-Fault System (Minn. Stat. 65B)

The practical effect is that after a crash, your own insurance company pays for your medical bills and lost wages regardless of who caused the accident. This is handled through Personal Injury Protection, commonly called PIP, and it's not optional. Every auto policy sold in the state must include it.


The logic behind no-fault is straightforward: get injured people treated quickly without waiting for lawyers to determine blame. But the system also limits your ability to sue the other driver unless your injuries meet a specific legal threshold. That tradeoff is where things get interesting, and where many drivers misunderstand their rights.

What Personal Injury Protection (PIP) Covers

Minnesota law requires a minimum of $40,000 in no-fault PIP coverage, split into two distinct buckets: $20,000 for medical expenses and $20,000 for non-medical economic losses like lost income and essential services you can no longer perform yourself (think childcare or household help while you recover). This structure means you can't shift unused medical funds to cover lost wages, or vice versa.


PIP also covers funeral benefits up to $2,000. The medical expense portion pays for reasonable and necessary treatment related to the accident, including hospital stays, rehabilitation, and chiropractic care. One thing to keep in mind: $20,000 in medical coverage disappears fast after a serious crash. A single ambulance ride, ER visit, and overnight hospital stay can eat through half of that.

The Threshold for Filing a Liability Claim
